PENAL CORRECTION FACILITY LAW
All prisoners must be granted the rights and liberties that are not fundamentally at odds with their incarceration. In other words, while an inmate is serving his or her sentence he or she must be afforded those rights and liberties that do not directly contradict the nature and form of his or her incarceration. The beauty of our Nation's Constitution is that it protects all parties equally and to every extent possible. While in the penal system prisoners do lose some fundamental rights that they would have outside the penal system; that is the nature and purpose of incarceration. However, the Constitution also guarantees that a prisoner's period of incarceration will not be cruel or unusual and that the penal system's actions must be reasonably related to the interests of the penal system. Thus the penal system may not unilaterally act to strip inmates of rights and liberties unless it is reasonably necessary for their proper incarceration. PROBATION & PAROLE CASES
An individual State has no obligation to create a parole system, or to grant parole simply because an inmate has already served the minimum sentence. However, once a parole system is in place it must be adhered to equally in all situations and parole should never be denied for unpredictable or speculative reasons. Mr. Decker has previously served on the Virginia State Board of Corrections for twelve years, sitting as Chairman for six of the twelve years. Presently, Mr. Decker sits on the Virginia State Criminal Sentencing Commission.
